1. Acceptance of Terms

By accessing the Aqualume Voyages website or using our booking services, you confirm that you are at least 18 years of age, have the legal authority to enter into these Terms, and agree to comply with all applicable laws and regulations.

If you are booking on behalf of others, you represent that you have the authority to accept these Terms on their behalf and that all travelers will abide by these Terms.

2. Services Description

Aqualume Voyages is a luxury eco-travel curation and booking platform. We act as an agent for verified travel partners including eco-resorts, expedition operators, and local experience providers. Our services include:

• Curated destination browsing and discovery
• Journey planning and concierge consultation
• Booking facilitation for eco-luxury stays and experiences
• Pre-travel documentation and travel storytelling services
• Post-journey impact reporting

Aqualume Voyages does not directly own or operate the accommodation properties, vessels, or activity operators featured on our platform. All bookings are subject to the individual partner's terms in addition to our own.

3. Booking & Payment

3.1 Booking Confirmation. A booking is confirmed only upon receipt of a written confirmation from Aqualume Voyages and the required deposit payment. Verbal or email inquiries do not constitute a confirmed reservation.

3.2 Deposits. A non-refundable deposit of 25% of the total journey cost is required to secure your booking. The deposit amount will be specified in your journey proposal.

3.3 Final Payment. Full payment is due 90 days prior to the journey start date unless otherwise specified. Bookings made within 90 days of travel require full payment at time of booking.

3.4 Currency. All prices are quoted in USD unless otherwise specified. Currency conversion fees, if applicable, are the responsibility of the traveler.

3.5 Price Changes. Prices are subject to change until booking is confirmed. We will honor quoted prices for 7 days from the date of proposal.

4. Cancellation & Refund Policy

We understand that circumstances can change. Our cancellation policy is designed to be fair while accounting for the commitments we make to our partners on your behalf:

• 120+ days prior to departure: Full refund minus the 25% non-refundable deposit.
• 90–119 days prior to departure: 50% refund of total journey cost.
• 60–89 days prior to departure: 25% refund of total journey cost.
• Within 60 days of departure: No refund. Journey credit may be available at our discretion.

We strongly recommend comprehensive travel insurance covering trip cancellation, medical emergencies, and evacuation. We can recommend specialist eco-travel insurers upon request.

5. User Conduct

Users of our platform agree to:

• Provide accurate and complete information during booking
• Respect all ecological guidelines provided for each destination
• Comply with local laws, customs, and conservation regulations
• Not engage in conduct that endangers wildlife, ecosystems, or other travelers
• Not reproduce, distribute, or misuse platform content without permission

Aqualume Voyages reserves the right to cancel a booking without refund if a traveler's conduct poses a significant risk to themselves, others, or the natural environment.

6. Intellectual Property

All content on the Aqualume Voyages website—including text, photographs, videos, destination descriptions, and journey narratives—is the intellectual property of Aqualume Voyages or our licensed partners. Unauthorized reproduction, distribution, or commercial use of any content is strictly prohibited.

Journey photographs taken by our team during your travels may be used for marketing purposes with your consent, as outlined in your booking agreement.

7. Limitation of Liability

Aqualume Voyages acts as an agent and is not liable for the direct actions of third-party service providers including resorts, airlines, vessels, or activity operators. We are not liable for:

• Acts of nature, force majeure, or government-imposed travel restrictions
• Health or safety incidents resulting from traveler conduct
• Loss, damage, or theft of personal property
• Delays, cancellations, or changes by third-party transport providers

Our maximum liability to any traveler shall not exceed the total amount paid to Aqualume Voyages for the affected journey.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, United States. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New York County.

9. Changes to Terms

We reserve the right to update these Terms at any time. Material changes will be communicated via email to registered users at least 30 days before taking effect. Continued use of our services after changes constitutes acceptance of the revised Terms. The current effective date is always displayed at the top of this document.
